How to pass H-2B visa in the US?

Can i apply for h2b extention if my h2b visa expired almost 3 years ago?

  • Above is my question. I am a current B2 holder now and found an employer. Can they apply for h2b extention if my H2b has expired in 2007? To apply for changing status is too expensive and my employer doesnt wanna pay but they are willing to pay an extention. And also can I (myself) apply for changing status and where should I start from? My B2 will expire in 45 days. I also had J-1 before. In 2006 I got my H2B, but left US before it has expired(2007), in 2008 I have got J-1, after it expired I applyed for B2, so I am on B2 now. I have heard I can apply for H2B extention if I had it less than 3 years ago. Is it true? Thank you

    You are way out of status and probably illegal in the US you B-2 may be void Best bet would be to leave for a year and start again ... or go see an Aila lawyer

You cannot apply for the H-2 extension because you no longer have that status. It is unlawful for you to seek or accept employment in B-2 status. You should depart asap or face deportation.
