What can i do to work / migrate to Canada?

  • I am a Filipino citizen and interested to work or to migrate in Canada. But I have a fear that I might have encounter problem for my Passport surname was actually my Maiden name ( MARCIANO) while all of my work related experienced was recognized by my married name ( MILLAN ) . Situation is that I am separated now (for about two years), but not yet legal - meaning no annulment case is file (but hopefully I can file the soonest) . Last year had made my passport under my MARCIANO's name, and was also able to go Singapore / Malaysia carrying that name, with only one supporting ID (SSS ID) still under my MARCIANO's name ,with then I saw no problem because I just go out for a travel vacation and no question asked if I am married or not, what I am referring now is that, would still be ok to use my MARCIANO's name applying in CANADA?, I really don't want to be tagged as MILLAN (but of course this would be difficult because we're married and we have documents and yes all of my work related experienced , if they need certification & recommendation were under Millan). But then I am very willing to start from scratch just to be use my MARCIANO's name (if all of the issue are just base from work experience), but I would be glad if we can fix it under my MARCIANO's name with no any issue of my certifications in my work. Please help me what to do, if filing annulment is not yet the solution for now, because that's why I really need to have work in CANADA to have money to file for my annulment and of course to have money to provide for my SPECIAL CHILD SON. Seeking for your advise

    Since the Philippines does not have divorce, and your credentials and supporting documents are in your married name, I suggest that if ever you apply, use your married name. After all that is your legal name whether you like it or not. You may mention that you are separated and have not lived together since 2007. I am surprised that the DFA allowed you to use your maiden name when you applied for a passport. (you did not declare that you were married I suppose) I understand that you want to rid yourself of "his" name but your actions may have given you additional problems both with the DFA and the Canadian Embassy if ever. Fix the problem first as it is only at the DFA. If you commit fraud by concealing your marriage to ANY embassy, your chances of working and/or migrating will be lost as you will be blacklisted forever. Your ability to immigrate and work in Canada is really not dependent on your marital status or the name on your passport. Your issue is qualifying for a work permit. Canada uses a points based program for independant immigrants. If your situation otherwise allows you to qualify, the name on the passport vs the name on the work experience can be dealt with.
