A Louisiana-based guest worker advocacy group filed complaints on Jimenez's behalf with the U.S. Department of Justice, the U.S. Department of Labor and the Tennessee Department of Transportation, seeking an investigation."We are pretty limited in what we can investigate," said Julie Oaks, spokeswoman for TDOT. "But we are planning to look at their payroll." In a media conference before confronting his employer, Jimenez, 35, said the landscaping company kept his passport and those of about dozen other workers in the U.S. on H2B worker visas. He said managers trained a camera on the trailers where workers stayed, threatening to burn the passports of those who tried to run away. "I had no identification on me," he said. "Nothing to prove who I am. The conditions were so hard. … We couldn't take break in this heat. One guy vomited from the heat, and they would tell us to keep working." Jimenez, who has worked in the U.S. for at least three years on the H2B visa, said he pretended to make a cell phone call outside the trailers where he and his co-workers were staying in Mason, north of Memphis, and then bolted after everyone fell asleep. A volunteer with the Alliance of Guestworkers for Dignity, an affiliate of the New Orleans Workers' Center for Racial Justice, picked him up. Jimenez said he heard about the group after a co-worker was fired for contacting it. If a person with a guestworker visa is fired or leaves the job, he must return home. Jimenez has 10 days to go back to Mexico. In the meantime, an immigrant advocate is housing him. "There needs to be a dismantling of the systems that allow this to happen," said Saket Soni, executive director of the New Orleans Workers' Center for Racial Justice.
