What are the steps to persueing a unfair/constructive dissmisal case in Ireland?

  • Hey guys, I am hoping some one could help me please :) Does any one know what are the steps to per sue a unfair/constructive dismissal case against your employer?? I think i have a case but dont know who to speak to about it or even begin to build a case or what to do. can someone please help?? thanks a mill.

    Start by contacting the Free Legal Aid Centre (FLAC). They have clinics dealing specifically with employment law and will advise you if you have a case and how to go about pursuing your employer. They may not be able to represent you, but will be able to help you find a solicitor. you can also find general information on unfair dismissals procedures in Ireland on the citizens Information website: http://www.citizensinformation.ie/categories/employment/unemployment-and-redundancy/dismissal/unfair_dismissal

Don't mind what Michael said. The processes for terminating employment is quite strict and often side stepped. Contacting FLAC is good advise. As far as registering a complaint. You will need to simply fill out a form for a 'Rights Commisioner', this is usually how things are resolved, then if appealed by either side it will move to the employment appeals tribunal and so on. You can be fired for any reason at any time. The employer doesnt need a reason to fire you. You cannot start a case.
