Will a deferred adjudication show up on a FBI background check?

Will a bench warrant for a traffic violation/missing court date show up on an FBI fingerprint background check?

  • I'm getting married in Brazil and I need to change my tourist visa to a permanent visa. I need to get a fingerprint FBI background check to give to the federal police here in brazil. Will this show up and potentially deny my visa request?

  • Answer:

Yes, absolutely it will. They run it through NCIC.

You cannot change a tourist visa for a permanent visa. There is not even such a thing as a permanent visa. Brazil does not deny you a visa. The U.S. government denies you a visa if you lie. They call this "material misrepresentation" which carries a lifetime bar from the United States. So whatever they ask from you, you better answer thoroughly and correctly. You don't know what the FBI background check will reveal, but you don't want it to reveal something you were trying to hide, unless you are a complete idiot willing to commit immigration suicide.

Absolutely!!

Only certain crimes are sent to the FBI. A common traffic ticket will not meet the criteria for the FBI to keep track of. Something like Hit and Run with an injury might meet the criteria for the FBI.

No really, traffic problems are common issues. If you were talking about fraud or drug related problems that would be a problem.
