How do I acquire the H1-B Visa from OPT Visa Status? I am currently under the OPT Status and problem I have is, getting a job is even harder in current economy status and OPT Regulation requires that all jobs during the OPT Period must be related jobs based on majoring from the college and should not be unemployed for more than 90 days during this period. I was majoring Hospitality Mgt and I am currently working for the job that is not actually related to my majoring and because it is actually impossible to limit myself to finding the jobs with criteria. So I was basically started to find some jobs that is not fully related but partly related as a customer service. I am working as a limousine driver and I am temporary keep it up with this jobs until find the jobs with in my criteria. When I seek some help from Immigration Attorney to ask some question about how to get H1-B visa through the jobs, I was told that based on the H1-B Visa requirement, working as a limousine driver will not qualify to issue the H1-B visa since Hospitality Mgt is jobs must be in the area of Hotel Industry, Tourism Agency, other truism or hotel related business.

To qualify for H1-b, you must have at least 2 years of experience in your field. You do not have appropriate experience, no less sufficient experience to qualify for H1-b. Furthermore, there is no shortage of experienced Hospitality Mgmt personnel among US citizens. Therefore, no employer is likely to obtain labor certification for anyone in this field. And third, hotels, etc, are laying people off - they are not hiring because business is way down. Lastly, only employers can apply for employment visas, including H1-b - you cannot apply. There is no way you can get H1-b visa. You are not qualified! Limo driver is not in line with requirements for your OPT, and you are in violation of visa requirements. You need to go home right away. Violating terms of your visa is grounds for denying you any future visa. So if you don't go home, you'll never have a chance of any visa in the future.
