Need to travel for 11 months, No re-entry permit?

  • Hi! I'm a green card holder and NEED to go abroad to study. Our academic year lasts 11 months, then I'll be back during summer break. Will I get in trouble if I don't get a re-entry permit? I heard that it's okay not to get a re-entry permit for travels of more than six months but less than a year as long as I can provide proof. Can I bring my report card and other school documents as proof that I don't intend to permanently reside overseas? Need advice! Thanks :)

You shouldn't need a reentry permit for an absence of less than 1 year. And as long as you have a good reason for being gone for so long it shouldn't be an issue. However, it is important that you are able to establish that you have a permanent residency in the U.S. Some green card holders never establish a permanent residency in the U.S. and therefore are at risk of being denied entry every time they return to the U.S. Also, in your case, since the academic year is so close to 12 months if you think you might not come back immediately I would play it safe and apply for advance permission to return to an unrelinquished domicile.
