How safe is it to buy a phone off of eBay?

Okay, I've had my phone since August, 2008 when my Verizon's 2 year agreement ended. My phone is an LG VX9400. If you don't know what that is, here's a picture. http://img158.imageshack.us/img158/2156/img80831vx9400lghd7.jpg Now this phone was pretty out-dated even when I got it about a year ago. And since my contract doesn't end until another year, and me wanting a more technologicaly advanced phone, I was just gonna buy one off of eBay. I just want to know, first of all, if I can buy a new phone off of eBay without paying for the 2yr agreement, and how safe is it to do so. Thanks.
