Question about jailbreaking an ipod touch?

I am getting one from here http://www.amazon.com/Apple-touch-Generation-NEWEST-MODEL/dp/B001FA1O0O/ref=sr_1_2?ie=UTF8&qid=1292947241&sr=8-2 Some people say you can't jailbreak the newest one but some others say you can with greenpois0n. Can you tell me how? Please don;t say something like it's illegal.
