  • Does anyone know how long a person is legally allowed to claim child benefit for after a child has left their residence ? My daughter has come to live with me after leaving her dads residence, she has been here 6 wks now. When I claimed for child benefit for her I was told it cant be paid to two people ( her dad and myself) which I understand. Yet the matter is my daughter hasnt lived with her dad for 6 wks now and I have been told by the child benefit that he is allowed by law to still receive the child benefit for my daughter for so many weeks after she left his home. However, the child benefit office wouldnt tell me how many week he is still allowed to receive the child benefit for. Does anyone know how many weeks he is allowed to still receive the child benefit for ? As I want to know how many more weeks it is going to be until the child benefit office will pay me the child benefit. The whole situation is a joke, how they allow someone to receive child benefit for a child that no longer lives with them ill never know.

I understand how upsetting this is. My son who is 18 was kicked out of his dads house two months ago..and I was legally obligated to pay him $300 a month in child support for tbose two months...and my son is with me (so I am supporting him twice!) Maybe try to contact legal counsel?

This is notoriously a difficult situation to get sorted! Quite often Child Benefit can't/won't close the current CHB claim down until that parents contacts them to confirm they are no longer the parent with care. Sometimes they do it this way because there is a risk that the child may have gone to stay with their other parent for a long holiday and not on a permanent basis.... or that the intention was for it to be on a permanent basis but the child (or even the parent) decides/realises they can't live together and choose to go back to the old arrangements. I woudl advise you to also try and claim Child Tax Credits. The claim is likely to be refused, however it will back you up that you have tried to claim all that you can as the parent with care. I would also suggest you ask her father to contact Child Benefit and Child Tax Credits both by phone and follow up in writing that he is no longer the parent with care, he must state in the letter the dates your child left his care and the date (same!) you became the parent with care, your name, your address, (as well as his NINO, childs name, etc etc). I've known cases like this take a minimum of 12 weeks to get sorted! When you phone them ask them for a specific list of things you need to do in order to get the claims in your name... "please can you tell me exactly how I can resolve this matter? What steps do I need to take in order to prove to you that I am now the parent with care?".... and lastly "I would like to advise you tht my local MP is called ********* and they have been informed of his matter and as such they have asked me to keep them informed of the result of this phone call so that they can take the matter further themselves should you now assist me in getting this resolved!".
