Who are the members of the civil service?

Does any one know about length of time the UCMJ applies to service members after they leave the service?

  • We were talking about it at my shop and none of us knew not evening our SNCOIC. If you know please let me know and if at all possible put in the reference or article or how you know this to be true. Obviously there is no statute of limitations on some crimes such as murder or serious offenses. But overall how long does the UCMJ govern a service member after they exit the service. Thank you in advance.

  • Answer:

As long as you are still under military authority. Youcan be on active duty, in the actiave reserves or in the inactive reserves All enlistments are for 8 years Most serve 4 years on active duty then 4 years in the inactive reserve.

if you are still in IRR, you are subject to UCMJ.

The Navy brought Captains Honors back from the retired list for a courts-marshall. Normally the wouldn't bother.................

the moment you are discharged the ucmj no longer applies to you. as a civilian you are protected under the constitution. many parts of the ucmj would violate your constitutional rights. therefore the ucmj can not be imposed on a civilian.crimes like murder and such would be prosecuted under regular state laws
