Who is the best player in argentina football team?

Can i sue a football team for assault after un-identified player broke my jaw?

  • after my team celebrated a winning goal in the last five minutes of a soccer game. an opposition player kicked the goalscorer causing him to fall, while I reached to help him up, another opposition player attacked me from behind fracturing my jaw in 3 places, I am not sure which player it was so I wish to prosecute the team in the first instance to see if they then offer up the culprit..

  • Answer:

No Given that you most likely signed a waiver to not sue when you entered the league. Even if you didn't, you would need to show that the team as a whole held responsibility for the attack. You're demanding the right to sue a group of individuals for the actions of a single man. Might as well sue your own team mates as well, they were there. Ever considered that it could have been one of your team mates, since you couldn't identify the guy anyways? What next, you'll sue a bar full of patrons, because one broke your jaw?

You can sue anyone you want, but doesn't mean you'll win. Most people who sue for money are suing for just that - money & not justice.

Absolutely. Even if you signed a "waiver", it only means you can't sue for ordinary injuries that one would expect from participating in the sport, not some criminal assault. First, file a criminal report of an aggravated assault: assault and battery by means of a dangerous weapon -- a shod foot. The police will investigate and hopefully identify the individual. Second, sue the individual for your injuries (whatever the insurance doesn't already cover) as well as the coach, the team, the school, the sponsors, the organizers, stadium security, and anybody else standing around watching the fracas, who created the environment in which a player was allowed to attack you. The one with the deepest pockets will typically offer to settle out of court. The others will often provide sworn statements, photos and other evidence to help you win against the one most liable. As a general rule, however, you can (in fact) sue the entire group of people (including a corporation and its employees, agents and suppliers) if you aren't sure which one hurt you, and let them figure out which one is going to pay. I have seen people sue the entire police department and name "Officer Doe 1" and "Officer Doe 2" while they were still trying to verify the identity of the individuals who caused the injuries to the plaintiff. EDIT: One difference from the "barroom full of patrons" is that the patrons were not acting in concert, like the team apparently was, and one patron is not necessarily responsible for the actions of another, unlike any organized sports in which the team clearly IS responsible for the conduct of each of its players. However, if there is a "group of guys" at a bar and they participate in the fight that injures you, they can be considered a "team" or a "gang" and held partially liable for their participation in helping their "friend" to beat you up and get away.

No you cannot sue an entire team for the actions of unknown person. Your insurance should pay for your injuries.

it'd be real hard to sue. your only hope would be if someone has a video of the incident, without proof it'd be almost impossible. did you make a police report or report it to anyone?
