Can a business forbid you from "linking" to them on your website?

Your Open QuestionShow me another » Can a business forbid you from linking to them? I want to put a link on my website!? I want to put a link on my website to a business but it says this on their website: "No material from any website owned, operated, licensed or controlled by Charles River may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way. " My question is, do they have the RIGHT to determine what I can and can't put on my website? If I want to do a small article about the business and then put a link to it, WHAT part of "legal" prevents me from doing so? It can't be just because they say so. I mean look at McDonalds. Alot of people put stuff about that on websites and it is copyrighted material, etc. So is this company just saying that hoping people "won't" write about them or link to them? Or do you really have to do what they say? PLEASE EXPLAIN! Thank you. ps mine is a link to it as the company fits in with my website theme.

Answer:
The address is not part of the web site and you are free to provide the address. That web site is equally free to block folks coming from your site if they wish.

First, the information from their website (which you illegally republished) does not indicate that linking to their site is prohibited. However the owner of a website does have the right to require you to remove a link to their site from yours. The fact that people post copyright protected material does not make it legal.
what they don't want is hot links. http://en.wikipedia.org/wiki/Hot_link
