Potential HIPPA violation question?

  • My wife is a nurse, and rushed me to the hospital where she works, she then started calling wives of coworkers of mine disseminating a very personal reason for me to be at the hospital, is this a HIPPA violation?

    If she was doing it as a nurse yes.. but I don't think so since she was acting as your wife...that just violated your trust.

It's tricky. If the information she disseminated was obtained through conversations with you, or through conversations with medical professionals who were discussing your case with her as your spouse, then no, it's not a violation. If she used her access to see medical records that she would have been unable to see had she not been on staff there, then yes, it's possibly a HIPAA violation. But that would be very hard to prove -- and it would need to be proven that she didn't have access to the information by virtue of being your spouse.

I don't know what a HIPPA violation is, but if you mean a HIPAA violation, then yes, maybe. Are you really going to file a suit against your own wife?

No, but it is a violation of HIPAA, and she could get the hospital a lot of hefty fines for each separate violation. Edit: even if it is not a violation of HIPAA, it is definitely immoral. It doesn't sound like she loves you. I'm sorry.
