What is a civil suit?

My attorney has not done anything on my civil suit except send me bills for talking to him, what can I do?

  • My building contractor is "highly connected" and my Pa lawyer is afraid of him. Suit was filed depositions taken and no action for two years. I directed him to get the defendants tax returns for which my attorney has billed me and has been paid and I received nothing and noe a year has passed. What do I do?

  • Answer:

    Things HAVE been done. Did the paperwork get filed by itself? An application must have been made for the tax returns, and other work has been done. If you don't like how he has done his job, talk to him and he will explain why you have unrealistic expectations.

Well, my sarcastic answer is to live with it, as this is common from the 'things' we call attorneys today. They can actually get worse, like in criminal cases where the help prosecute you, so nothing is an acceptable alternative if you can't have a positive action. The way it is supposed to work is that, in cases like this, you can file a complaint on him. Each state has different ways of doing this, but you are 'protected' in most cases. You can either file a complaint, with the Bar Association (the guys who give him permission to practice in your state), or file a civil suit (Ahem) against him too. The Bar is a little more likely to investigate your complaint and do something, but not much. All scum stick together today, be they lawyers or cops, or doctors, or whatever. But, they have laws that should help you somewhat. You may be able to find your State Bar online, and even do most of the work that way. You can also contact the BBB, or Better Business Bureau, to file a complaint, and even have, in some cases, them mediate for you. This route will also cause a small, but noticeable, black mark on his reputation, so others can know he's not worth the cash wasted on him. The civil suit issue, you have experience with. Most lawyers won't sue another, or if they do, they let them off 'easy.' Usually, you need to get another, unrelated lawyer, to do this, and it may not go anywhere. You see, they don't care if you sue them, because they know how to lie and get out, or just pay you and forget about it. Again, I have experience here. I know one lawyer, who went to my old church, who neglected his files and was sued. He didn't care, and even told the client to sue him. When it went up, he lied and said the client never contacted him. Along with that, he took extra money from a woman, who paid him and he 'forgot' to record the payment. In another, he tried to blackmail churchgoers into paying tithes, or go to court! Nice guy. I would try the Bar, then the BBB, or both. And, of course, good luck.
