  • My son,who was completely in the wrong,was issued an MIP(minor in possession) . a few months ago.We went to court and he was sentenced to MIP classes,community service,and was given a fine.He did all that was expected of him from the courts.The classes and community service is given and assigned by a company contracted out by the county. If you do not complete your classes or community service a letter is sent to you stating you have until this certain date to call them and complete your sentence.He completed all of his classes,($100,to do which he paid).I took him to his last class,and his community service.His supervisor from the charity place told me he was done. Yesterday he got a letter from the court stating his license was suspended for noncompliance and he would have to pay a reinstatement fee of $100 to get it back. Him and I went down to the company which had the contract with the county to get things straightened out.I had a feeling that no matter what no one was going to take responsibility for this paper snafu, and my son would pay the price for their incompetence.I explained how was it possible for him not to have gone to his last mip class when the paper they made you fill out in your last class was about what you learned from this experience.Which he did.Blah,blah,blah...I was starting to get a little irritated,because of their foul ups which they wouldn't take responsibility for. She kept asking Nathan who taught his last class because it was a different lady then before,this was months before and he couldn't remember her name.I asked the her why she didn't have a record stating who was teaching the class on that day,which is required of any supervision Company. Oh, and my recorder on my phone had been playing the whole time, with her knowledge.The next thing I knew some man comes in the room asking if there is a problem? I tell him first off before you say anything you need to know that this conversation is being recorded.(The lady already knew)He tells me that it is illegal for me to record any conversation,I told him only if you do not know about it.Am I right?Shouldn't you have the right to protect yourself legally?

Montana is a two party state (all party really) so you must have a persons permission to record them. Once the person said no, you must shut it off.

That depends. Does the building specifically prohibit recording devices? If it does, then you are still in the wrong, even if you did make the other lady aware of the recording.

That depends on the state you're in. In mine you have to stop if they say no.

In any state it's legal to record someone with their permission. Otherwise every form of recording would be illegal. Did we really need that long drawn out story in order to ask that question? "I had a dispute with a company and was recording the call after telling the person I was doing so. They then told me that was illegal" << That's all we needed, since none of the rest had anything to do with the question.

That depends on the state. First of all, from this point forward I would keep a record of ALL paperwork, even if it seems insignificant, and even if there are people who should have a copy of that paperwork. Keep all records, faxes, e-mails, also maybe even keep a record of all phone calls with these people--if it's legal to record the phone calls in your state without the other party's knowledge do it. If that is not legal, take notes every time you speak to these people... write down the time, who you spoke with, and what they said. Then you can present it and it should be handled accordingly. I would speak to a higher-up, if possible, if he really did comply and if this really is a mistake on their part. I wouldn't be surprised if it is a mistake on their part. I know people who work in that field, and I can tell you that a lot of them are flakes themselves (and by "they" I mean the people who are working at the very forefront of the field, not management).
