Legal definition of paragraph in lease, Am I in violation?

  • In my lease it states: "This community allows the consumption of tobacco products within individual apartments and appurtenances including, but not limited to, patios, balconies, etc. Smoking is prohibited in any areas designated as "non-smoking", which include all common areas; i.e., clubhouse, pool and spa area, playground, laundry rooms, parking lots, carports driveways, stairwells, walkways, grass areas, etc." I have 3 questions: 1. What is the legal definition of an appurtenance when it comes to Apartment living? 2. Can I legally stand/sit right at my front door and smoke without being in violation of my lease? 3. Is my front door area considered a common area? (by legal definition) Thank you :)

Are you planning on standing in front of your door and smoking just to show the neighbors that you can? The best way to get along with your neighbors would be to be respectful of them. If you are asked not to smoke in a particular place, don't run to the lease, if its not out of line don't smoke. On the other hand, if the request is out of line ("Please don't smoke inside your own apartment"), then give them your tall finger. My goal would be to get along with the neighbors, not to delve into the fine details of what is or isn't a "common area".

NO. The law states you must be at least 20 ft away from buildings when smoking outside. You CANNOT stand by your door and pollute everyone's right to clean air. Either respect your neighbors or move out to a camp for disgusting people with that filthy habit.
