  • Answer:

Well I knew some one at my families lake, and he was picky about how many hours he worked at the camp a week... this was so because if he worked too many hours, he wouldn't recieve his unemployment anymore.

might have a shot at a partial claim. get thee to the Unemployment office. You have nothing to lose

You still can file for unemployment even if you have a job. But only if..... 1) you where hired for a full-time job ( 30 hrs or more per week). 2) you get 21 hrs or less at any week. *If you get compensated for being on call different rules may apply. *You may even qualify if you have / had a part-time job. *You should had filed for unemployment 3 weeks ago, but when you file for unemployment give them the last day of work or first day when you started not having work. ( 3 weeks ago). Or the first week where you had less than 21 hrs. * While on unemployment you are allowed to make extra money. 5 years ago I was allowed to make $ 80 a week extra without getting my unemployment reduced. If you make more money than what they allow you, you still get unemployment but the unemployment money is prorated. Note: I hate to tell you, but the way I see it, your company laid you off without telling you. They are trying not to pay you unemployment. You have to understand that the employer has to pay part of the unemployment money you could / will receive. Since you are on call, save your itemized bill from your phone company that shows all your incoming calls and outgoing calls. This way you have prove that the company never called you. Things may have changed the last few years, but the above is a basic guide, but below is a link for your questions. I would file a unemployment claim and see what happen, be prepared that your company will give you problems. Always ask questions, and if your claim is denied you always can appeal a decision the unemployment made and there is no cost involved. here is a website for the unemployment in california. http://www.edd.ca.gov/

You can't file unemployment unless you were fired. The idea would be to find another job. If you signed papers saying you knew you were on call and the hours would vary then there's no way you will get unemployment.
