What does a "clerk of court" do?

I need to know if a court date will be set for a motion to dismiss or if the clerk is suppose to just give it?

  • I need to know if a court date will be set for a motion to dismiss or if the clerk is supposed to just give it to the judge for him to make a determination before the actual court date for the appeal. I'm in illinois. I read conflicting information on the internet. one site will say a court date will be set. Another says to make sure it gets to the judge for him to make a determination if the original court date should be allowed.

    It's up to the judge - sometimes they will have a hearing but sometimes they will simply make a determination without doing the hearing.
