Can I sue a retail store for falsely accusing me of shoplifting which led to me being arrested?

I went with a friend to this store(Don't want to say name, but big retail store:opposite of Wal-Mart) and I was walking around browsing,looking at stuff.Headed to electronics showed my friend something cool for her ipod she put it in her basket and took off to look at girl stuff. Walking out the store an employee asked me to give him back his belongings, I asked what belongings which I didnt have anything that belonged to them, I had just bought 2 pairs of jeans and a pair of socks.they took us to the back of store to an office and found out that the person i was with had stolen over 200 dollars worth of stuff,but i was not aware of this! they asked me to empty my pockets( i had sport shorts and a white t shirt!no pockets!) and so they took both of our info and called the cops which arrested us and charged us both with petty theft. Clearly I did not steal or was aware that my friend was stealing I was not with her when she was doing all this bull Sh*t!!! So is it possible to sue for false accusations which led to me beign arrested?and if so what are the chances of me winning the case or having a case?Should I sue them for money?

I work as a loss prevention agent for a major retailer. When arresting accomplices, it is generally not recommended due to the high probability of liability. To be arrested as an accomplice. I have to prove that you had both intent and knowledge of the crime, eg. Your friend held open her purse and you shoved the items in it, or you both were in the same fitting room and something went missing (even the , if I find you had nothing on you, I would release you and apologize) There are several elements they need to make an arrest on you. If you did nothing and they can't prove it. I would fight it. They then have to provide the burden of proof (video and statements) making it appear as fact you knew what you were doing. I would then start making calls to the store manager, the loss prevention manager, ask for their regional managers number and call their corporate number and complain about your false arrest. If you are telling the truth. You can make 10s of thousands of dollars by suing the company. They will settle out of court for probably 25k plus. Good luck to you. No, you can't sue them. They had every reason to suspect you. Go to court and be found not guilty and be done with it. If they have no evidence, you will be fine. It's the consequences of your choice to go shopping with that girl. Oh, and find some new friends.

You won't get any money. The store acted properly, and you were a legitimate suspect in a criminal event. If you don't want to get accused of shoplifting, stop hanging out with criminals.

Clearly you did not know? Wrong. That is not at all clear, even by your version of the story. If you are trying to ask if the store folk made a false report that led to the arrest, read the report. Drawing the wrong conclusion from the right facts is not actionable.

May I ask your age? If you're a minor, the implications of this depend on your state. I don't quite understand what you're wanting to sue for here, I'd be more worried about your record as opposed to money... You're going to have to decide what you want. Hiring a lawyer will cost far more than a petty theft fine. Do you not have a court date?

no, the store was going off of information or what they witnessed -- or thought they witnessed -- this wasnt a false accusation, this was based on the fact that you were with her so they assumed that you were in on the theft. people make mistakes, let it go.....
