Can you use student loans for anything?

If my mother used my information to get student loans is there anything i can do to make her pay it?

  • While i was living with my mother, she was in a lot of debt and knowing all of my information she decided to get two student loans in my name. Because, i lived with her i had to agree to it. Shes done this with credit cards as well which Im not worried about because im filing bankruptcy so those will be gone. Shes used my name for credit cards and used them and im assuming she got away with it cause if she ever got her id checked her name is relatively close to mine. Anyways, she used my name to get two student loans. one student loan she is the cosigner of and the other loan , my dad is the cosigner. my lawyer informed me that bankruptcy will not make this go away and i think its unfair that i have to pay for it since i didnt use it. is there anyway i can go to court and explain the situation so that they can make my mother pay for both the loans since shes the one who used my information and forced me to go along with it? Oh also one of the loans if i remember correctly she had it deposited directly into her bank account. she had me come along to do my fingerprint and everything

    It depends. Did she forge your signature? Did you get any of the money? Did you agree to do this, or was it done behind your back? If you could prove some things, you might have a chance. If she forged your signature on any application, you could use that against her. If she covered all of her bases, you might have a problem. Whatever money she spent she should be responsible to pay back. You should tell her you are going to call the State Attorney to help you figure things out, if she doesn't try to make good. Some things are going to come down to your word against hers. Your lawyer is right when he said that bankruptcy will not clear a student loan, which could follow you for the rest of your life. If you were over 18 years old, you are just as responsible for any debts she may have got! And your father too? Actually it's partly the Credit Card company's fault for not checking her or you out when they issued the cards! And why two student loans? Are both of you going to school at this moment or what? From what I have read, sounds to be your whole family is messed up! The credit cards yes, bankruptcy will do away with them, but not the student loans. It seems to me, you didn't protest very much when she started using your name to get any of these finances!! How many times did YOU actually buy anything with these credit cards, and were the money from the student loans used for your education? If you can afford an attorney, I don't understand why your mother would do something like this!? She must have known she was actually committing a crime!

You agreed to it. The fact that you felt forced into it doesn't matter, you agreed to take on the debt. It isn't the credit companies' fault that you couldn't say no to your mother.
