Can an expired registration ticket be dismissed?

If a registration suspension was rescinded can a ticket that was recieved after the suspension be dismissed?

  • I received a suspended registration for no insurance notice from dmv on Jan 14 (but i actually had insurance) i sent in proof of insurance plus 100 restoration fee(as the notice requested) on feb 2nd, i was pulled over on feb 18, they gave me a ticket for unregistered/uninsured vehicle, on feb 21 dmv received my proof and removed suspension and returned the reg restoration fee, so im assuming this was a rescind based on the fact that they did not take the restoration fee, . now, can the ticket on the 18th be dismissed under these grounds ??

    If you have paperwork that proves your car was insured during all of this time, then I don't see any reason why a judge would uphold the ticket. Obviously the court determined that you shouldn't have had a violation because you did nothing wrong since they removed the suspension. So, unless you have these facts wrong, I don't see why the ticket would be upheld.

Yes, probably. If you lived here where I live you would need to take all of your paperwork to the courthouse in the township where you got the ticket. Who knows where you live and what the rules are there though?

I would certainly take the ticket to court. With your proof that your insurance was always active, then the judge might dismiss the case. However, he could just as easily decide to let it stand because you were knowingly driving on a rescinded registration.
