Is it legal to tax completely underwater land? I have a unique situation. I live in Connecticut and the house that I bought 3 years ago sits on a tiday esturary that at high tide fills to 7 feet of water.. The deed to the house came with a separate piece of property that exists in its entirety,totally underwater, in the middle of this estuary. The department of Environmental Protection has told me that I cannot construct anything over this parcel, and the deed says the same thing. Nor can it be owned apparently, according to them, or sold as there is no value comparison. According to the DEP I cannot own it. But yet I do. So, the city I live in is taxing me on this property as Vacant Land. It's the bottom of the LI Sound. Can anyone help me with this? I've looked all over the internet for statutes without luck. The city cannot tell me how they arrived at a value since this land has never been sold. And I have to fight it in court. Any help would be greatly and humbly appreciated.

You have to fight it in court. You already said that. Are you expecting someone to step up and persuade the city to change the evaluation? That is why courts exist.

If this weren't serious, it would almost be funny. The city can tax you for land that you have ownership of, according to them, this is indeed the case. If the DEP is stating that you CANNOT own the land, then I would ask them for the federal statute that says such, and relinquish ownership of the land, which in turn would relieve you of taxes on it. The city must be able to show you how it derived the tax amount, often it is appraised value, sometimes, it is original sale value, etc.
