UNEMPLOYMENT APPEALS?

Unemployment appeals and determination?

  • Hello there, does anyone here think they can help me out with some accurate information? You see, I had been on Unemployment for about a year until, I found a job working at a Thrift Store a month ago. The job proved to be too far of a commute from my home, so on only the third day of my being employed there-- my boss and I came to the mutual agreement that it would be best for me to find another job, and I resigned. I tried to claim my regular benefits from Unemployment thereafter, only to be met with a phone interview by them concerning the reason I quit. Once I told them that the commute was not feasible to me-- they told me they would have to call the job to verify the story. Only for them to call me back and tell me that my boss said I quit because I was "pregnant" and couldn't work! Which is completely false, I am not sure if she had me confused with another employee, but needless to say she set me aback with unemployment with her statement. So at this point I've been told Im waiting on a letter of "determination" regarding my benefits. What exactly does that mean? And in the event that the letter entails I was denied my benefits--how soon can I appeal and how likely would it be for me to win said appeal? My employer clearly provided a false testimony!!

  • Answer:

He may well have you mixed up with another employee. But it really doesn't matter. If they use your story you will be disqualified. You quit.

Other answers

Why did you accept the job if you were aware of the commute when you were hired? According to your post you quit due to the commute. Regardless of what the employer said would not change the fact that you were the moving party in the seperation and it would not have been for a compelling reason that would cause the average person to leave their job.
