We had a random search at my school. They searched my purse in the classroom while I and my other classmates were in the hallway. I didn't think they had the right to search my personal belongings. They took my phone and camera. They didn't inform me or anyone else that they took our items. Could that be considered them stealing? if there is a policy about no cell phones or cameras and u had one, then you are in the wrong, and just plain outta luck. Think about the zero tolerance of guns at school, and someone had the same attatude as you nad put it in their pack or bag, and then someone got hurt. Rules re rules for a reason. No one needs a cell phone at school. Communication can be by actually talking at break times, the rest of the time is to learn.

No, it's not stealing. It's confiscation, and if you brought the items to school in violation of a school rule then it was a lawful confiscation. They do have to return them - although it's legal for them to have rules as to how. (Where I live, for example, cellphones will be returned only to a parent, not to the child himself/herself.) The legalities of the search vary depending on the circumstances. At worst, though, even if the search was unlawful that would merely mean that evidence it discovered could not be used against you in a criminal prosecution. Richard
They do have a right to search. They do not have a right to confiscate those items from your purse and keep them forever. They have to return those items to you in a reasonable amount of time otherwise it becomes a criminal offense of theft. The Phone and Camera are not weapons. Talk to your parents an let them deal with the jerks at school.
First: They do in fact have the right to search your personal belongings on school ground. Your rights are incredibly limited. In addition it will not be considered thievery it is confiscation of banned goods. Second: If an item is confiscated it will depend on the schools policy regarding return of confiscated items. It could be that they are considered forfeited. I would check your school handbook for more information or go see the principle. The moral of this story: Don't bring your phone to school if you aren't allowed to.
If the rules of the school allow them to search students possessions, and if they allow them to confiscate items that are not allowed in school, then the school is within it's rights. You agree to those rules when you enroll at the school and attend it. If at any time you don't agree with the rules, you are free to either contest them or attend school elsewhere.
They probably had reasonable cause to search your personal belongings. The fact that you're irate means that you think they found something wrong. Also, there's no such thing as student law. There is only law.
