  • My sister filled a case against somebody and went to the court 3 times and each time no interpreter was given to her, only 1 interpreter showed up which was for defense side, court told her that they will appoint one next time. Her trial day came and still no interpreter!. When judge asked her to state her case, the first sentence of her mouth were "No English, Need interpreter" and she looked at interpreter who was sitting with defense. Interpreter came and stand next to my sister and translated for few minutes. But shortly after She (Interpreter) went back to defendant and set on chair with him and stayed there for the whole trial translating for defense. Defense had a false witness but my sister had not idea what witness say because she does not speak English. however interpreter translated every word of defense witness to defense ear when my sister ws the one who really need to know what was said. Judge totally agreed with the witness and did not even ask my sister to cross examine or disprove her. My sister had all the evidence in the files proving witness wrong but she had no idea what the witness said. Trial went on for 40 minutes and all this time interpreter was sitting next to defense on chair translating everything going on. Lawsuit was for amount of 5k & 2k. Judge misunderstood(off course lack of communication) and thought my sister already received 5k (but she didn't) and awarded her just 2k. How can a trial go on when the first sentence from my sister mouth were "No English" and no interpreter was given to her by court and judge never spoke to her during 40 minutes cauze he know she doesn't understand the language. Is this legal? When judge ruled, my sister had no idea what he ruled. Everyone left one by one but my sister keep sitting on chair because she had no idea trail was over. the room officer came to her and signal her that she can go now. This was in Arlington, Virginia court. My question is this legal? It was not a fair trial. What type of lawyer do I need to file a case against a judge or court?and I need a cheap one

    You can't sue the judge as he would have immunity. You can appeal on the grounds that your sister was denied the interpreter. You need an appellate lawyer. Edit: Wait, was your sister in a civl case or a criminal one? If it was civil, then its her own fault for not getting an interpreter. Its not the court's job to provide one for her in civil suits. If criminal, then she has grounds to appeal.

Perhaps a civil rights attorney, but I agree with the first answerer. If your sister plans on staying in the US, it would behoove her to learn our language.

If your sister is going to stay here it would benefit her to learn english. I don't know if it is legal, she is the plaintiff, I don't know if the court has to provide an interpreter for the plaintiff, just for the accused. She should have brought her own interpreter. Life isn't fair and life isn't free.
