How long will it take to get the bail money back?

Will the bail bonsman get their money back if they catch a defendant later?

  • What I mean is when the bail bondsman posts, say $10,000 to the court for a defendants release, and the defendant doesn't show up to court, then that $10,000 is not refunded, but the bail bondsman or bounty hunter catches that defendant later and takes them to court/jail is the $10,000 then returned to the bail bondsman?

    If the defendant fails to appear in court, a bond agent is allowed by law and/or contractual arrangement to bring the defendant to the jurisdiction of the court in order to recover the money paid out under the bond, usually through the use of a bounty hunter. The bond agent is also allowed to sue the defendant for any money forfeited to the court should the defendant fail to appear.

Depends how much later. Every state has it's own rules about how long after bail has defaulted the surety can cure the default and get his money back. (In my State - CA - the forfeiture grace period os 180 days, which the court can extend or toll at its discretion) Richard

Yes, every state is different. But at the end of the day the bondsman can sue the defendant or whoever signed the piece of paper to bond the person out. The person who signed is usually the first person they go after.
