How can the police prove you did not stop at a stop sign?
-
So I was going to a couple estate sales in the neighborhood and this is what happened on a Saturday at approximatly 9:15a.m. as stated on the ticket I just received. So you know the ticket states I was only going 15 mph in a 35mph zone 25mph when school is in session. This is what happened upon being pulled over by the police at a stop sign. Police:Do you know why I pulled you over? Me: I have no idea being that I saw you when I stopped at the stop sign Well I'm pulling you over for not stopping at the stop sign (He goes to run my plate, etc),then comes back Police: By signing your not proving your guilty I then proceeded to tell him that I'd see him in court and asked if he had recorded it on video. He said his car was recording but he didn't know if the stop sign was in the line of view. Then he told me if I had any more questions. I said no. He told me to drive safely and I in turn told him that I was. So 1. I was going well under the speed limit for that area as stated on the ticket 2. Prior to coming to a complete stop at the stop sign , the cop was in clear view at the right hand side of the street If a video tape isn't running I don't see why these police can't give anyone and everyone they choose fit to give a violation to all day long a ticket 3. Unless he can prove with video tape that I did not come to a stop at the stop sign there is no reason why I should not be proven innocent here.

Answer:
The proof lies in the credibility of the officer (who has nothing to personally gain from writing you a ticket) and the driver (who can escape a fine by denying the allegation of failure to stop). Rather than taking the officer's valuable time with a you-can't-prove-didn't-stop defence, why not just pay the fine and move on? EDIT. It is easy to say that your time is just as valuable as that of the police. Maybe even more so--for all I know you might have a higher income than the police officer, or have to take time away from your work or business. There is one huge difference, though. You pay for your own time maybe, but the taxpayers (including those who obey traffic laws and stop at stop signs) pay for the officer to be in court. I'm trying to point out that you have a duty to your society not to look for some smart way to weasel out of a ticket by trying to get a judge convinced that the constable has inadequate or flawed evidence.

Yes. Squad cars have video records. The dash cam would catch you redhanded. Also, the mere word of the cop is superior to your word.

There was a report on tv about this last week. Some jurisdiction was making 100's of thousands on the police giving tickets for this, it was the towns main source of income. The money went right back into the police department to pay cop salaries and issue more tickets. You may be completely innocent and still have to pay. That doesn't mean you shouldn't show up in court and try to fight it.

Well honestly it would be your word against his.. and if you go to court and loose, you'd have to pay not only the fine, but all of the court costs.. so in the long run which is cheaper.. you don't get points taken off for running a stop sign or at least I didn't.. I got stopped cause my wind shield was really messy one time, and I knew that it was there I just couldn't see it but I did it right in front of a state patrol, and I was like sir my windshield is a mess in the direct sunlight.. And he didn't fall for that.. IT there again didn't take points, and so I paid the fine, I don't think I want to go to court.. Alot of people do the california stop, stop look a second and run.. so who knows...

I would not waste my time in argument with a cop. Just pay your ticket.
