  • So me and my long term girlfriend recently moved 3 hours away. She wanted to move. so we moved in january of this year.. i got a job at coca cola and she couldnt find a job.. So we got an apartment but she only wanted her name on the lease, being together 2 years i thought ok. I paid the deposit as well as rent. turned out she had been using me for my money and had this whole thing planned. this past wednesday she didnt talk to me all day.. i had comeback up north to get the rest of my clothes from my brothers house where we had lived previously.. then without warning her, her brother in law, and her brother in laws friend came and started taking the bed which was equally ours. i thought to myself. hey cool they have come to get our bed, then her brother in law through me against the wall and started choking me.. i demanded what was going on and she claimed that i was cheating on her which is bs. anyways she kicked me out of the apartment, stole $200 i had in cash at the apartment. she also left a $200 bill on my credit card. she is going around telling people i beat her, she told people i called her dad to tell him that i understand why he left her mom if her mom and his daughter were the same. reason i know all this is because her cousin and her best friend called me up cause what she was saying didnt make any sense and told me all.. either way they told me she pulled this exact same thing on her previous ex. they told me that she claimed i was stealing her money, even tho she didnt have a job and i paid for everything.. the rest of my ex's family has taken her side and refuse to speak to me. so.. i have printed out my bank records proving what i was paying for, i also called the landlord and asked him for a written statement that i was paying rent and deposit. she said i have been harrassing her with phone calls yet the last 2 phone calls were made by her.. so i printed out my phone records as well to prove that. also to prove i had no contact with her father.. friday night she texted me saying that she loved me. i ignored it, then saturday morning she called me to ***** me out for doing all those hurtful things.. afterwards her cousin called me to say that she said i called her and said horrible things, she also told me that there were 2 other people in the room with my ex when she called me. So she was just putting on an act.. i have said i would take a polygraph to prove my innocence, wednesday i suggested that she should take a polygraph and she refused.. 2 years and we were so happy together, and she just completely turned. I do believe that she knows what she is doing is wrong and regrets it, i know she loves me and i still love her, but what she did is unforgettable. so i am planning on suing her for pro-rated deposit and pro-rated rent since she kicked me out march 9th and i just had paid for all of march.. the landlord is giving me a written statement confirming this plus i have my bank records. i am also going there with a cop to get the rest of my stuff including the $200 thing she bought on my credit card.. Is there anything else that i should do? i still do want to get her help but she need to face up to her lies.. I once had an ex who lied about me all the time. so i went to her parents and friends and showed proof that a lot of what she was saying was lies and i told them that she needed help. they confronted her and got her help.. 3 years later she thanked me for helping her, she said that at first she hated everything about me for doing it but admitted it made her a better person. Can anyone tell me what goes through someones mind to make them do this?? what are all my legal actions? she claimes she paid rent and deposit but i have proof that states i did.. among the bed can i sue for a portion of that? i know that i cant prove the $200 in cash.. but what else could i do?

    You will just have to gather all the evidence you have about paying her rent and deposit and sue her for it. You will probably need to take her to small claims if she won't pay you back. Also, if she physically assaulted you, you could make a police complaint and file for a temporary restraining order. She can't kick you out unless she gives you proper notice with your subleasor/subleasee relationship. But the lease agreement doesn't affect your verbal agreement/contract you have with your girlfriend. The lease was a contract between the person who signed it (your girlfriend) and the landlord. If you lived there too, the only privity you have with the landlord is privity of estate, and the landlord can kick you out (with proper notice), but they can't sue you for violating the lease terms because you weren't in privity of contract with the landlord, you were just in privity of contract with your girlfriend. However, with all that being said, because you lived there, you may have a tenancy at will with the landlord and can be liable for any damages you caused while there, or for non-payment of rent owed for the time you were in possession. And if you pay rent, he can't kick you out for non-payment because you have a right of possession until proper notice is given. Go to your local courthouse and ask about what you can do in regards to the improper eviction and whether you can file a domestic restraining order if necessary.
