Should I cash my check from AFLAC?

I hired someone 6 months ago and just found they didnt cash the check?

  • Ok I hired someone to do my flooring work alittle over 6 months ago. I figured they cash the check I never really bothered checking asuming someone that does a job would want the money and cash it. I had 2 checking accounts the one i wrote the check on is now closed as I didnt use it as much as my chase account now the person contacts me saying they cant get there money because I closed the account and they want a new check or cash but right now I dont have the money to spear I do feel i still owe it but what can I do they wait 6 months never cash the check and now make all sorts of demands they even are saying they will turn me in for writing a bad check but i didnt write a bad check for almost 6 months the account was open they could have cash it at anytime. I guess my question is can they do that turn me in for a bad check? or sue me? I feel helpless as i do feel i still owe the money but since they waited so long to cash it shouldnt i be able to at least make payments?

    If they say on the check for six months and didn't cash it, in many cases you are not obliged to pay them since they did not pass the check in time. This can be handled in Small Claims court.
