My son was electrocuted in a holiday resort swimming pool last year and I am seeking a refund on our holiday.?

Last year whilst on holidays my elsest son of 17 was electricuted in a swimming pool at a well respected holiday resort in QLD Australia. He was taken to hospital and thank goodness was OK. I asked the resort for a incident report which they provided and they had admitted to a faulty light in the swimming pool which had caused a electric shock through my sons legs and he was thrown out of the pool onto the ground. He suffered with pain throught the holiday and also when he arrived home but is now ok and doesn't have any pain or damage that we are aware of. I would like to ask the resort for a full refund on the holiday as this happened on the first day of a 2 week holiday which restricted us in doing everything we wanted to do. What would be the best way to do this without legal costs as I am a single mother working 2 jobs and can not afford legal assistance. I would appreciate you advise. Regards, Joanna

The fact that you've waited a year to ask for money back on this doesn't look good for you. I would still write to them and ask for some monetary compensation with the incident report they provided you; but I'm not sure exactly how much you will get or if they will give you any money back at all. The fact that you did stay the remaining two weeks makes it seem a lot less worse then you are claiming. Plus I really do not think that a pool light could have the strength to throw him from the pool. That's pretty much impossible; so either you are exaggerating or the hotel isn't telling you something. If you booked through a travel agent or tour operator contact them as well.

The lights in pools are mostly low voltage, or securely grounded, and if it had a path of current, the water would have conducted it away, and the breaker would have tripped. Someone is not truthful!

The incident was so traumatic that you still carried on for the rest of your vacation? The resort might be liable for any exces medical costs (for instance if you used private health care), and as a good will measure they might be willing to throw you a few dollars. But refunding the holiday? I doubt that. Now if you'd had to CANCEL, you might have a claim. I'd write to the resort and ask for some compensation, but failing that, there is nothing you can do without legal costs.

This request for compensation with the resort should have been made at the time of the incident. Especially if you are looking for them to take responsibility and give you a full compensation of your stay without any legal fees. A year later is quite a while to go pursuing any claim for this incident, especially because your son didn't end up being seriously injured from this accident. You can try writing to the resorts head quarters and include a copy of the incident report with a letter of your request. But I doubt they are going to pay it any mind, or give a full compensation a year later.
