How to Override a private set property?

Do U.S. Citizens have a constitutionally set right to own property?

  • I am doing an essay on how the constitution allows us to achieve our goals, and I set a goal as to own a large business or corporation. Is there anywhere in the constitution that says you can own property or private property? I've looked, but only have have come up with in amendment 5, how it says you cannot be deprived of property. Please halpmeh!

  • Answer:

You mean the 4th Amendment, but also look at the tenth, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." In other words, if the Constitution does not give the government to right to stop you from owning property, than they have to right to stop you.

It is your assignment, read the Constitution again.

You are gonna have to do some research!! Very good topic, but if you knew anything about the Constitution, it would be easier. The Constitution was written to protect individual rights and property rights from government tyranny. PERIOD. The Free Enterprise is our economic system, our means of production. Privately owned and operated for personal benefit. The free Enterprise CANNOT legally be taxed unless it volunteers itself. The reason why the Income Tax seems inescapable is because most every job in this country requires you to sign a number of documents, with fancy wording, stating that you are agreeing to be a representative of a corporation, or intity. What all this means is simply that when you sign working papers (which are required by pretty much every employer that you apply to) YOU ARE WAIVING YOUR RIGHTS as a Natural Citizen that is protected under the constitution, and agreeing to represent an artificial person that is not protected by the Constitution. Google search the terms Capitus Diminutio Minima, Capitus Diminutio Media, Capitus Diminuto Maxima. It is difficult to avoid, because if you do not sign the document waiving your rights, you do not get the job. So, why do all employers volunterily pay taxes which leads to the requirements of signing those documents? Because without doing so, the buisness loses ALL state and federal benefits provided for all private or comercial buisness. And furthermore, most people accept the mis-truth that the income tax is required by law, without investigating it themselves. ---I could go on forever. Read the full Constitutional document...not just the Bill of Rights. Good Luck! And I hope you fall in love.

No, there is nothing that guarantees a right to own property. However, the 5th amendment says private property cannot be taken without fair compensation, and the 5th and 14th both say that you cannot be deprived of property without due process of law. That's about as close as it gets. Also, the 14th amendment has an equal protection clause, which is much more important. For example, the government cannot ban a particular race from owning property, since that would violate equal protection.
