When should I get my car title back?

How can i get my car back from my soon to be ex-husband. His name is not on the title and he refuses to give i?

  • I have left my husband and moved out of our house. I went back with some family to get the rest of my clothes and other belongings. I was able to get some of my furniture, photo albums, ect. I discovered that he had pawned jewlery that was given to me by my great-grandmother. My intentions that day was to also get my car and take it back with me. I bought and paid off this car before I even met him. His name is NOT on the title. And he is refusing to give it back to me after making several attempts. Once he even agreed and when I went to get it he wouldn't let me have the keys. I have tried getting the police envolved, but they said they couldn't do anything because we aren't legally divorced. I actually haven't started the divorce process because I haven't had the money after having to find a new place to live, moving expenses, ect. So my question is, how can I get MY car back from him even though we aren't legally divorced?

    If the local police aren't doing anything maybe you could try the state police. It seems like it should be considered stolen since his name isnt on the title.

I don't understand why you don't have a set of keys to your own car. If you have the title to the vehicle, you should be able to get another set of keys, using the VIN number. You can also have the car towed, if you have the title. If you don't have the title, go to the BMV and get a duplicate.

Call the cops. The car is not in his name.

Send a tow truck to retrieve it. No keys required. You may need to get new keys made, but if he still has a set you will want to change out the ignition anyway.

Go see an atty and file charges against him for "conversion." It's a legal claim that another has taken control of your property as if it has been stolen. I know of one case where an auto dealer trying to drive a hard bargain wouldn't give the car owner their keys back - the owner walked out of the place and filed against the dealer for conversion and the dealer got stuck big time.

Contact your lawyer, get things rolling with the divorce, and the rest will fall into place.

do you have a set of keys? take it! If not, you have to ask for it in the divorce. my girlfriend after 6 months of being separated got bumped with his truck and he DEMANDED they switch cars - she went to the police and there was nothing she could do ... she now had a $300 car payment and the car he took was paid for . . . that is how it stuck in the divorce, too . . . .

Either call a tow truck, which you'll have to pay for, or report it as stolen.

Go to the local pawn shops and see if u can get the jewlry back, call the cops and ask them how to leagaly get your car back. Other then that i would hire someone to steal the car from him and change the lock right away.
