Filed bankruptcy six months before filing for divorce, can judge order payment of discharged debts?
-
I filed bankruptcy in September 2009, all debts were discharged, divorce filed in May 2010. My ex-wife took the car that was included in the bankruptcy when she left the state prior to the filing of divorce. The car debt was solely in my name, and I did not reaffirm the debt when I filed for bankruptcy. In the divorce proceedings she was awarded this vehicle. Can I be ordered to continue making payments on this debt that was discharged in the bankruptcy? I was under the understanding that a lower court cannot order the payment of debts discharged by a Federal BK court?

Answer:
Yes, whoever is paying the person responsible for the estate(trustee) has to keep making those payments or else the bankruptcy will go into arrears. And then you have to start over on even more unfriendly terms.
