How can I get out of a lease for an apartment?

How can I get out of an apartment lease in Florida?

  • My wife, infant son and I live in an apartment and our lease will be up in 2 months. Now we are supposed to close on a house in a week or 2. Now the landlord is responsible for the water utility bill and has on 2 separate occasions allowed the water to be shut off, for 2 days each time. Now since he already technically broke the lease, can we just leave? I don't want to be sued and it's only a couple months. Thanks for the help.

  • Answer:

No you do not have legal cause to break the lease. Talk with the landlord and see if he will voluntarily let you out early, if not you are stuck with any early termination fees or the balance of the lease.

Does your lease contain an early termination clause? If so, pay the fees as outlined and move when you close on your house. If not, talk to the landlord and see if he will negotiate an early termination with you. If none of these options are available, you are legally liable for the lease and he could sue you.

If you had an issue with the water being turned off, you should have made mention of it then; he may have had a perfectly legitimate reason to do so. Too late to use that as recourse; it is very obvious you are just looking for an excuse. Talk to your landlord and see if he will be willing to let you out early. If not, you will have to pay whatever lease break fees are outlined in your lease. You are free to move whenever you like, but you must still pay the rent.
