How can I get out of a lease for an apartment?

Not living in apartment but still paying. How can I get off the lease?

  • I moved out two months ago. Two girls still live there. No matter what I do it's impossible to get someone to take my spot on the lease (I don't blame them no one would want to live with these girls). I am trying to find a way out so I don't have to keep dishing my pay checks out for a place I don't even live anymore. It's a commercial apartment so the landlord is not sympathetic or trying to help. I offered to help them move to a two bedroom and the apartment complex won't allow it. The only thing I can see that might help is 1) they have a cat and on the lease it says no animals or 2) I know they have parties and drink when they are both 19. Would either of those help me get off? I really am desperate and some people have told me to turn in my key to the landlord and stop paying taking the chance that the girls won't sue me. Any opinions or suggestions would help. Thank you!

19 is actually adults and people of 19 are totally free to attend or hold parties at which alcohol is served. Having a cat when a landlord/owner says "no pets" is rather common and certainly not unusual. Perhaps you are being a little bit unreasonable and I'm sure your landlord will agree. It was your own decision to move out and the landlord is in no way responsible for that

Hmm, sounds like weirdo college kids. The only thing I can suggest is making an ad on Facebook, Twitter, or whatever social site you're apart of. Whether these are college kids or not, put up some fliers around your neighborhood/campus. Those usually get good responses. You'd be surprise to know how desperate some people are to find a place to stay. Also, I've never heard of an apartment where you couldn't break your loose even with a financial penalty. Ask about it.

The only way to get off the lease is if the landlord will allow you to be removed from the lease. It doesn't sound like that's going to happen. If you report that the two girls have a cat that the landlord doesn't permit, then they will typically be told that they have "x" amount of days to get rid of the cat or they can face eviction. Unfortunately, if they are evicted -- you will also have an eviction on your record because you are on the lease. Drinking is illegal at 19 and if you called the police everytime that they had a party, they may get issued some citations, but I wouldn't recommend that you get involved in that. If they are damaging the apartment while drunk, then I would notify the landlord because you will also be responsible for damage done to the rental. Honestly, unless you fear for your safety, I'd move back in if you're paying for the place - especially if you still have more than a few months left on your lease. If your former roommates will agree to let you out of the lease, then the landlord will typically let you out... but it's unlikely they'll let you out since you're paying and not even living there. Heck, move back in and let them know that you won't allow illegal activities to happen in the unit -- if they're drinking, tell them you'll call the police. It's a valid request since you are against illegal activity and you may tick them off enough that they want you off the lease.
