What is a commission sales associate?

Florida can broker pay commission directly to sales associate or must it be paid through broker?

  • I worked for 1.5 years under a broker and I did not sign a independent contractor agreement since we were basically employees with taxes taken out by employer, medical insurance etc. However; we did receive commission. Now I am working for a new broker and my old broker wants to pay my new broker can't he pay me direct since no monies or commissions are due the new broker?

    Your old broker can pay anything other than commissions due directly to you. If the monies in question are commissions only, it properly should be directed from broker to broker. Since you are no longer licensed to your old broker, he should not pay you directly. I would assume that your new broker will not take a percentage off for himself. If he does, you do not belong working for him.

By law commissions are paid only to those involved in the transaction and it is disclosed. Anyone else receiving financial gain, it has to be disclosed in the contract to all parties involved.
