My landlord entered my garage....?
-
My landlord came unannounce and entered my garage "because the door was open" and began going through my things. They found a screwdriver with grease on it from my husband fixing my son's bike and claimed he knew it was "resin"(marijuana). That is the only item he found and was taking pictures of it and anything else in the garage that had oil or anything looking black. He stated he came because the garages had an exceedingly high power bill and wanted to find out why. Why didn't he call and ask, he lives 6 hours away. My son came back from riding his bike and they told him that they were calling the police on his parents for drugs. Me nor my husband do drugs and that was completely uncalled for. They then preceeded to go upstairs(I live in a condo) and walk in apartment "because the door was unlocked" and my husband had just gotten out of the shower and was standing in his underwear, with the landlord and his wife entering and seeing him and made no effort to respect the fact that he was "exposed". Proceeded to tell him that he found the screwdriver with resin and was going to make a police report. Then he said well I don't want to make a police report because I don't want the cops coming and kicking down the door. OOOkay! When questioned about entering with no notice, they stated they came because of the power bill. What a joke...to get to the point...we then felt like our privacy was invaded and called them after they left and asked if we could get out of the lease because what they did was illegal, and they proceeded to say no, but we will violate your lease and make a police report about what they took pictures of in our garage. Can they even do that? I mean you found a screwdriver with grease on it, in a garage..surprise surprise. These people are nuts, everything that has broke we have had to fix because we notified them and they said they would send somebody and months would go by with nobody showing up to fix anything. I mean do they have a case with pictures they took illegally of a screwdriver? Can they violate my lease for that? I would say they violated the lease when they entered the garage and my condo without prior notice or knocking. Had they tried to knock, someone would have answered. Please give some advice....i live in Minnesota

Answer:
What he did was illegal he can't come on the property without letting you know or collecting rent. You can sue him or something like that.

You are right, land can only enter dwelling for maint issues or emergency. He broke the law by entering and taking pictures, he is not a police officer. He should know the lease . I would ask lawyer for a free consult. I manageed/owned apts for years and I can not believe this was done. If he felt somehing was wrong he could have called law enforment and have good cause for them to even do anything.
