What do board members do?

I am having problems with my HOA board that is acting under the min# required members. What can I do?

  • Our by-laws required a minimum of 3 people on our board. For the past 2 years, it has been operating with only 2 members. They have rejected members that petition to go on the board to bring it to the minimum or up to the maximum. They are making major decisions (spending thousands of dollars) without involving or, at the very least, informing the community. We have petitioned the president to step down, but the 2nd member is refusing and is now acting as a one man show appointing his own 3 man board. What recourse does the remainder of the community have against this dictator"?

    Legal action should be taken. If you pay the HOA and they don't tell you or ask before they spend money then something is wrong.
