Washington- Tenant admits growing pot in house, can I serve 3 day eviction, even if plants are gone? STINKS!?

  • Washington My renter had already served notice ( he paid this month, and has a $1600 deposit) , and is to be out on the 30th of this month , but during the preliminary walkthrough ( he offered!) the overwhelming stench of pot was everywhere . This is a lovely home we own, and he addmitted to me (only, no witnesses) when I asked about it and holes in the ceiling downstairs, that he had "grown 20 plants and made a quick $5,000" There are 2 cats locked in the home 12 hours a day , and the smell is unimmaginable (to me) even a week and a half after the plants were removed. I have recinded the permission for the cats to be in the home, now I think I want him out because I am worried what other kinds of drugs he may make because he will be pissed about me telling him the animals cannot remain. Can I serve him 3 day eviction notice, even though the plants are gone? Ive consulted a cleaning firm and it will cost over 2,000 for air scrubbers, ionizer and am told all of the walls , ceilings, and fixtures must be washed with a special soloution. How do I get him out NOW.??

He is leaving at the end of this month, which is about 2 weeks away. Don't bother wasting your time. A 3 Day is a notice to pay or quit. You have to give 7 days to cure a lease violation. If he is not out on the 30th, I would strongly suggest you hire a flat rate eviction attorney to get him out of your property as soon as legally possible. You are obviously a newbie landlord so you don't want to take a chance on losing a lot of income by screwing up the eviction due to a technicality and having to start all over again.

. yes you can serve him a 3 day notice to quit or vacate ... But ..... if he knows anything about rental laws he can postpone the eviction for about 90 days and force you to post a cash bond in order to force him out! right now your looking @ him being out in 2 weeks without a big legal hassel. I would sit tight and get him out @ the end of the month and would withhold the damages that I could prove in a courtroom as in the holes etc. as to the smell of the weed it will go away in time. The cats you will need to do some clean up work. if you piss him off he might trash your house then your looking @ bigger problems.
