Can I tell my landlord to take my security deposit as my last month's rent?

  • I was laid off from my job less than a month ago, and I cannot afford to live on my own anymore, so I am moving in with my fiance until I find another job. My current landlord charges me 175 euros a month for rent, and when I moved in, I paid an extra 175 euros as a security deposit. I need to move out by the end of the month because I cannot support myself anymore. My landlord never gave me a contract, or a lease to sign, so I really don't know what kind of protocol to follow (many apartments in Europe are month-to-month.) My question is, since I am moving out at the end of Feb, and since I have only been living in my apartment for 2 months, can I just tell my landlord to keep my security deposit as my last month's rent? I have not even lived here long enough for there to be any wear and tear on the apartment property. I have a very strong feeling that if I pay her February's rent, and then ask for my security deposit back at the end of the month, I will not receive it back. Like I said, no contract, no lease, and a somewhat shady landlord. I am only staying here one extra month so I can give a reasonable notice that I have to leave. I think that is the right thing to do. Should I tell my landlord to keep the security deposit as my last month's rent? Or should I pay the monthly rent of 175 Euros, and then not be surprised when my landlord tells me she will not reimburse me for the 175 Euro security deposit? I have very little money left, and I don't want to get screwed over. Thanks.

In most places it is against the law to use security deposit, which is for damages, as rent. Just pay what you owe and avoid being sued
