Where To Buy Rubber Stone Molds?

Options as a tenet in a house with mold, not zoned properly and exceeding maximum occupancy. Located in VA?

  • myself, my husband and our 6 month old moved into a 1 bedroom house towards the end of march. a few weeks after moving there my son started with some respiratory issues, we went back and forth to the pediatrician and make a few trips to the hospital where he was admitted each time. the only thing the hospital could come up with is he possibly had asthma but was to young to diagnose. a family member had actually painted the house before we moved in and after hearing about all the trips to the doctor told me some mold was on our back bedroom wall that was painted over. my husband and i started picking at the wall and found our whole back and side wall was covered with black mold on the backside, we notified our landlord, he came and said he had some sheet rock and would bring it if my husband wanted to put it up. he came back a couple of days later with about a half sheet of sheet rock that had been cut up and was broken around the edges and that's when we showed him that it was everywhere (he assumed it was in one little spot) he seemed a bit mad that we had taken it out even after we showed him the mold all over the cinder blocks and the torn out sheet rock. he said he'd buy the materials if my husband would replace it and gave us $150 to get everything. anyway we replaced everything and i asked him if we bought the paint if we could paint another color besides white, he said that was fine and we painted a orangish pink color with light brown trim. fast forward to the first saturday of this month, my son had our cell phone and i though it had fell at the head of our bed and when i moved the bed, surprise, molds back. i told him saturday he said he would come sunday, never called sunday, on monday his stomach was upset so he couldn't make it. a family member was concerned for my son and called the county and let our landlord know they were coming, no more than 30 minutes after he found out the county was called his stomach apparently wasn't upset and he was there with his contractor/friend. the county mans first biggest issue is that our house "doesn't exist". our landlord owns the house next door and apparently our house was built without a permit and is considered to be the garage to the house next door. we were told the mold wasn't as big of a problem with the county because they don't really have codes because it affects people in different ways. after the county came our landlord and his friend dug a trench around our house to find that it was pretty much a pool under our foundation. they drained it and put some stone, put roofing tar around the bottom, put some gravel and raised the dirt. no mention of fixing the roof that we told him was messed up over a month ago because he didn't think that was the problem. he tried to get my husband to re-tar the roof for $50 about 3 weeks ago but when he declined that was the end of it. two days after the county came our landlord was called and informed our house is to small for 3 people. we owed him $500 for rent but were told we should hold onto it until the issues were fixed or put it in escrow, we didn't know how we would go about putting it in to escrow if the house technically doesn't exist. anyway our landlord stopped by 2 days ago with a pay or quit notice that says we have 8 days to pay and a letter saying we have to move due to occupancy laws and nothing to do with the mold. we asked him how it would work as far as our deposit and he said he'd walk through after the rent that was owed was paid and we had vacated to assess any damages because he could see our screen on our storm door was ripped, its not, my son has pushed it out of the rubber and i'm going to put it back just like i have 20 times over the summer when hes pushed it out. my husband asked him if he wanted our room painted back white since we did paint it another color even though he had to do work to the wall anyway, he said he would like it painted since if we would have asked he never would have let us paint it, when i told him that we did ask he changed it to, "well i never would have let you paint it orange". i'll paint it back white no problem. my main question is what should we do at this point as far as paying rent. we've been camping out in our living room since the beginning of the month and we've taken everything out of our room because all of the dressers and anything else near the walls had mold growing on the back. in addition to doing the walls in our bedroom, he wanted the back of the house sealed and the whole house painted which we did and the laundry room sealed and painted which we did. my husband put the storm door up. he put windows panes in because the previous tenet had put plexiglass in and all he did was take some money off the rent here and there which came out to a few hundred dollars. sorry its so long, im trying my best to describe all that i can to see if anyone can give any advice as to what to do. when he came with the letter and the pay or quit he mentioned "

    hi, trust me you do not want to live there anyway. toxic mold kills!!! play hard ball with your deposit. i would tell you just to squat until the cows come home but its not a safe living environment

Couple things...It sounds like the landlord Is working to resolve the issues you where having. If your husband and the landlord verbally agreed he would remove a portion of the rent for fixes to the house the it's just that. If have a Rental Agreement you must pay it. Your not a judge... Just because his Garage was converted to a unit that doesn't entitle you to withhold payment. All the guy would have to do is fix te issues and get it inspected... And it would become a Dwelling. If you still didn't pay he could ruin your credit After the Garage is then considered a dwelling. He would probably get slapped with a fine. "IF" and Only IF he Created the dwelling and didn't have it pass code... If he purchased the property and was not informed of this he is NOT liable for anything. You Signed a Lease and Agreed to X...Per month you must pay it or Be Evicted. Pretty simple. You can only Not pay IF and only IF the City Sites that the dwelling is Unfit to be lived in. It would then be classified by City law. Beyond this.. Ever thought of Opening a window? maybe just a crack to let the heat escape? Maybe Spraying that "mold" with Bleach to kill it? .
