How can i get my name off of the lease for an apartment with my ex?

I lib my ex for a little over one month. Both our names are on the lease because she is over 18. We split and I left. Now I want to get my name off the lease. So I called the office and they said me n her both have to sign a paper and my name comes off. Only problem is she is spitful n wont do it. I heard if I sign that paper and have it noterized the landlord will tell her either sign the paper or move out. I don't know how true that is. Any other ideas on what I could do. Its a 1 year lease we signed 3 months agoago

The only way the lease can be modified is if all parties agree. So if your ex won't agree, you are stuck and responsible for half the rent. Your landlord cannot force her to sign the lease modification. If she doesn't pay, you could also be evicted and be sued for the rent. Or if she does pay the full rent, she can sue you for your half.

If she won't do it, you can't. The LL cannot force her to sign it, and they never would, b/c that makes one less person they can come after when there is a problem. You are stuck.

It seems to me there are several things you need to know before you sign the paper. 1. What is your liability if you sign, is the apartment releasing you fully, or are you still liable for the remaining 9 months. You could be liable up to the time the apartment re-rents or the lease expires. 2. What will happen to your ex, you do not seem to care if she gets thrown out on the street, even though you entered a lease agreement together. Does she have the income to qualify to rent the apartment on her own. It would be nice to know. 3. You call her spiteful, but in reality both of you are spiteful. You refuse to honor an agreement you signed and there is no indication you are willing to pay the penalty for signing the lease. Since leases are rarely reported on your credit, you should be able to get a new lease, then give notice on the old lease when it is 10 months old. Only problem, to protect your credit you will want to make sure your ex is paying the rent.
Sorry, but the only way the landlord can force her to move is if she does not pay rent and is forced to evict her. At that point the landlord can go after her, you or both of you for the unpaid balance of the rent you obligated yourselves to. Don't really consider it spiteful, you are dumping the balance of a contract you BOTH signed on HER to pay herself. Hindsight tells you that maybe the two of you should not have signed a lease together, but that does not undo the fact you signed a contract.
