Can I get housing benefit if I have a mortgage?

Can I make an arrangement with a landlord if I can't get housing benefit I won't move in?

  • I am asking on behalf of my disabled partner. She has enough money for her first month's rent and deposit but is scared if she takes on the lease of a flat and applies for housing benefit because her name is on a mortgage of her father's it may affect her housing benefit and she won't get the full amount. She will then be left with a six or twelve month lease. What can she do?

    It is all down to negotiation - don't agree to something if you are not certain you will be able to honour it or else you will end up with CCJs against your name. The council should be able to pre-assess if your partner can qualify for housing benefit, but if she is moving in on her own (and she is u35) then it won't be much anyway - enough for a cheap room in a shared house. I can not see a ladlord agreeing to a 'trial period' because the biggest 'cost' for a landlord is changing tenants.

A landlord won't agree to that he needs a tenant who can pay the rent Remember if she is on a mortgage she's unlikely to get h/b Also many landlords don't take tenants who are on benefits, as benefits are not seen as a secure or permanent income so check all of this out first, before viewing any properties, or singing up to anything

I think she needs to talk to her local citizens advice bureau- they really helped us when we needed help with our housing etc. I know that my friend who is disabled is not entitled to housing benefit as they have a mortgage (making her a home owner) so this may well be the case with your partner. Sorry I can't be more helpful but do make sure she takes advice before committing to anything.

HB has rules and regulations, but there is always slight differences depending on your circumstances. Go to you local housing office and ask to speak with a housing officer, preferably a senior one, as only these can make decisions on special cases. They will tell your partner what she is entitled to, being disabled she may be entitled to her benefit being settled quicker. The ONLY people that can tell you your particular entitlement at HB Office, make an appointment and go and see them. If you have a difficult HB Office (and there are some, then go to CAB or you local Disability help office. Shelter can help they are brilliant, and you can find them on-line. Good luck.
