Early termination of tenancy agreement and offset 2 mths deposit for rent?

• Agreement is for 12 months.. tenant paid 7 months rent in full. On the 8th month she paid rm 600 short. On the 9th month and 10th month she does not wanna pay any rent but told me to off set against the 2 months deposit. She wanna leave end of 10th month after giving 2 months notice. For the 11th and 12th month, she does not wanna pay any more rent She only paid one month electricity bill so far. The rest I paid. The rm 600 short paid plus the electricty/water/Astro/Indah water oustanding , more or less cover the utility deposit. Can I sue her for breach of contract at Small Claims Tribunal as amount is slightly less then rm 5,000.

  Yes. It is illegal to use Security Deposit as rent, that is intended to cover damages. She owes rent for 4 months plus late fees and interest. Also the utility bills. So yes you should sue her and ask for all money owed plus your fees for suing her.
