How inheritances affect Section 8 Housing?
-
Hi I just received a lump sum settlement amount from my mother's 403(b) in the form of a check. I was the sole beneficary of her acct. and I already cashed the check too. I live in a Section 8 apartment and I have a Section 8 voucher. Seeing that I received this money will I lose my Section 8 entirely? I'm also on SSDI because I'm visually impaired and Social Security said my benefit amount would not be affected unless I was receiving SSI which I am not but I'm guessing that Section 8 has different rules.

Answer:
You need to report it however this is excluded from your annual income Lump-sum additions to family assets, such as inheritances, insurance payments (including payments under health and accident insurance and worker’s compensation), capital gains and settlement for personal or property losses. However if kept in a savings account it will be considered a asset!

You are required to report all changes in income to Housing Authority. I dont know if you would lose your voucher since it is not an increase in your income, but your rent might go up. If you fail to report t his information and they find out the consequences can be severe from repayment of all rent subsidies to criminal prosecution for fraud. Your SSDI is not affected, thats true, because that is based on your disabiity but Housing rules are very strict.
You need to report it to the government. This is resources you can use to live off of and it is morally wrong to not report it.
The government has the legal right to claim all monies they have extended you. Had your rent voucher cost the government 8k over the year then they are entitled to 8k of that money.
Your tenant's handbook should say how they handle lump sum income, I know they do want to know about your monthly income but I don't know about lump sums. You could also check the hud.gov website and find the Section 8 voucher program area, it might say something in there too. If you have to disclose it then don't try to hide it, because then you will lose your voucher for sure and be barred from getting Section 8 anymore.
that is concidered a "resourse" which effects your rights to section 8. If however you pay your rent ahead the resource is no longer. However if you do not report it you can go to jail for fraud, see HUD web site for more
