Do you have to pay the money back if you have been overpaid?

Social security overpaid me, can I pay them back in monthly payments?

  • I received a letter from social security stating that I was overpaid X-amount of money, and that I had to pay the amount back. Now what I need to know is can I pay it off monthly, or is it like a one-time payment. (I tried calling them and was stuck with a robot).

  • Answer:

Your letter should have included some hints as to how you were supposed to take care of that. Please try the phone again, or even go online for more information. My best guess is that it will be deducted from your forthcoming checks and they should have told you what to expect.

You might consider contacting your congressman's office for help. Right or wrong, these offices are set up to help with these type of red tape issues. Going in person is the best route to approach the problem. I think the SS people require an advance appointment.

Depends on "how much". Generally they just take it out of your next check.

Before you pay any money back, you need to make sure the overpayment is correct and you really owe the money. Many times the overpayment is incorrect. If the overpayment is less than $1000, you can get an automatic waiver just for the asking. This means you would not have to repay the money. You also have the right to ask for a waiver even if the overpayment is over $1000 if you think the overpayment was not your fault and you cannot afford to pay it back even in payments as low as $10 a month. You can negotiate a compromise or you can negotiate a repayment plan.
