How do i get out of a discretionary trust fund, and what is it?

  • hi, i'm in australia so i don't know who can help me or whether it varies from country to country, but basically i am in a discretionary trust fund... i have no idea what one is, but i am in it for my mums business. i am only 17 so what i am asking does not really apply for me yet. okay my sister who is 21 and i never get any of our money .e. tax return from the government because it goes intot his trust thing, and mum and dad just give us to it in cash, recently our government gave all tax payers 900$ and that too went into the trust account and mum and dad are yet to give it to me or my sister even though it is my money. i was wondering whether i can get out of the trust fund and how i can get my money, as they have no right to it!!! what do i have to do? i know i don't get out of it when i turn 18 as my sister is still on it... i talk to my folks about it but they don't listen or say "it will happen, don't worry about it" but i want out... please help me!!

    Trust funds are are different in how the rules are written. Odds are you do not get control of any monies but only receive what your parents decide. There is no legal way to break the trust. Your sister who is of legal age can ask the Trust Fund Managers to see the guidelines concerning the Trust and disbursement rules.
