I am trying to fix this uninsurance claim i filed. Can someone please help me? I am so confused?

  • I know this is long but this is a summary of what i emailed them and what the emailed back...The last paragraph is their response but i dont understand what it means. FYI i remember i stated that i filed for a claim back in 2008.I had a letter back saying i didnt qualify of course because i wasnt working. i only filed to see if i could get money. i didnt understand EDD or how it works. for me filing it in 2008 be the reason why im not getting anything?? which is total BULLcrap. but yah, just thought id put that out there. but this year i met all requirements and said i was awarded with 820 amount but it shouldve been more... well here it is,.,, Topic: Update Information - Made Mistake on Application You wrote us the following: I have filed for unemployed insurance benefits on 8/15/2009 and received the "Notice Of Unemployment Insurance Award" on 8/25/2009. I noticed on #1. it says my claim date begins 08//09/2009. How is that so if I never filed earlier than that time. Please explain, I am confused. #3 & #4 states my maximum benefit amount is $0.00. To my understanding, in order to earn the amount of weekly benefits you had to have at least made $900. But I've made well over $900.00 the last 3 months I've worked there. It states #5-#6 my total earnings during the quarter is $820.00. It is incorrect. I have estimated my paycheck stubs, and I've made $1,874.00 prior the three months before I've been laid off. (June 2009-August 2009). From My understanding my weekly benefits should be $73.00 which was stated in, "A Guide To Benefits & Employment Services" booklet that was sent to me. #11 states the wrong months of which I was working. The wrong quarterly endings. June 2008- Dec- 2008, I was unemployed and was not working for my most recent employer during those dates. I've worked from February 2009- August-2009. I hope this could be worked out and discussed in the near future. Thank You. Here is our reply: Ms. Luckett, All Unemployment Insurance (UI) claims begin the Sunday of the week in which the application is filed, regardless of the last day of work. There are many reasons a person may willingly or unwillingly delay filing the application. If you feel that the effective date of your claim is incorrect, you may request that EDD schedule a telephone interview for the purpose of demonstrating good cause to backdate the claim. The effective date of your claim is based on the date you first contact the Department. The effective date determines your "base period", and as a result, your benefit amount. A base period is a one-year period of earnings, divided into quarters. The base period is used to establish a claim and calculate an award. You may wish to review your wages during each quarter of the base period to determine the best time to file. You will not receive any benefits until you actually submit an application or call EDD to file a claim. If your claim begins in: January February or March, your base period is the prior twelve months ending the last day of September. If your claim begins in: April May or June, your base period is the prior twelve months ending the last day of December. If your claim begins in: July August or September, your base period is the prior twelve months ending the last day of March. If your claim begins in: October November or December, your base period is the prior twelve months ending the last day of June. You may review the Benefit Table: http://www.edd.ca.gov/pdf_pub_ctr/de1101bt5.pdf which provides your weekly benefit amount based on your highest wages in a calendar quarter during the base period. You may need to download the free Adobe Reader to view and print linked documents. http://www.adobe.com/products/acrobat/readstep.html. To establish a valid claim, you must have earned at least $1300 in one quarter of your base period, or at least $900 in your highest quarter and a total of 1.25 times your high quarter earnings in the four quarters of your base period. When calculating your benefits, the EDD provides you a Weekly Benefit Award and a Maximum Benefit Award (MBA). Benefit Award. i have NO idea what this means....what do i do now?? it is EXTREMELY impossible getting anyone on the phone! i call like every single day from the time they open to close. i know i have money from the taxes. why is it impossible for me to get to it. :( thank you.. also im in california

  • Answer:

Your claim begins in August, so your base period is from March 08-March 09. If you were unemployed from June 08-Dec. 08, that's a large amount of your base period. The months of Feb. and March of 09 can be counted, but that's not a full quarter. April-August of 09 to not have affect your unemployment because they are not within your base period. It says your claim started on August 9th because they only go by Sundays. August 15th was a Saturday (but it was in the week of August 9th). Did you work March, April, and May of 2008? How much did you earn during that quarter? I would suggest going to the UI office and requesting a phone interview, or you'll have to keep calling. If you wait on the line long enough you will get a live person. It doesn't sound like you worked enough of your base period to qualify though.
