  • i am receiving a pension from a job I retired from. I am now working with a new employer and am currently being layed off because of lack of work. Can I still receive Employment Insurance

  • Answer:

Eligibility is not based on a needs assessment. You don't mention in what State you reside but generally speaking in order to be receive unemployment insurance benefits one must meet specific eligibility requirements before benefits can be paid. Individuals must: Have received enough wages during the base period to establish a claim. Be totally or partially unemployed. Be unemployed through no fault of his/her own. Be physically able to work. Be ready and willing to immediately accept work. Be actively seeking employment. If you meet those requirements you will receive unemployment compansation.

Other answers

Yes, but do not use the word "retired". "Retired" means that you no longer work and have left the labor force and are cannot receive unemployment. You left the earlier job, but continued to work, so do not call yourself retired. Since the pension is not from your most recent job, you should be able to receive unemployment -- if you say that you are receiving a pension but are not "retired".
